In the course of business and production activities, projects generate sources of pollution that directly impact the surrounding environment. What is Periodic Environmental Monitoring?

Periodic environmental monitoring involves regular observation and tracking of the quantity, trends, and actual status of the negative impacts that enterprises have on the environment once they are in operation. It includes analyzing environmental quality indicators such as soil, water, air, etc., evaluating the effects of pollution sources on the surrounding environment and human health. This forms the basis for proposing effective environmental protection measures and appropriate treatment plans.

This process is one of the crucial and indispensable activities in environmental management and protection. The importance of periodic environmental monitoring is substantial, especially after conducting environmental impact assessments for projects. It helps enterprises monitor specific impacts during their operations and propose more effective environmental protection measures.

Content of Periodic Environmental Monitoring:

Each production, business, or service facility is required to conduct periodic environmental monitoring every 6 months, with the main content including:

  • Reporting general information about the enterprise's production activities and any changes over the past 6 months.
  • Periodic measurement, sampling, and analysis of surrounding air quality, industrial emissions, and wastewater; measurement and sampling frequency should be conducted every 3 months.
  • Comments on the results, with the enterprise committing to address or improve environmental pollution conditions if the results do not meet the standards.

The Purpose of Periodic Environmental Monitoring:

The purpose of periodic environmental monitoring reporting is to monitor and evaluate each company's data. This helps assess the impact on the environment, enabling companies to address pollution issues, develop effective pollution reduction measures, and propose appropriate treatment methods. Specifically:

  • Evaluate the current state of the facilities' environment.
  • Assess the impact on the surrounding environment and the health of employees working at the facilities.
  • Report on the monitoring, implementation, and environmental protection efforts of the enterprise to the competent state authorities.

Thus, competent state agencies can formulate policies and collaborate with enterprises to protect the environment.

The Significance of Periodic Environmental Monitoring:

Periodic environmental monitoring is a vital factor that determines the effectiveness of environmental protection activities:

  • It's a tool for controlling environmental quality.

  • It provides information for environmental technology.

  • It's a crucial link in assessing environmental impacts.

Environmental components and emitted substances that need periodic monitoring:

  1. Water environment includes continental water, groundwater, seawater, and rainwater.
  2. Air environment includes indoor and outdoor air.
  3. Noise, vibration, radiation, light.
  4. Soil and sediment environment.
  5. Radiation.
  6. Wastewater, emissions, non-hazardous and hazardous solid waste.
  7. Hazardous chemical emissions and accumulation in the environment.
  8. Biodiversity.

Entities Required to Prepare Periodic Environmental Monitoring Reports:

Periodic environmental monitoring reporting is the new term for the previous "periodic environmental monitoring reports according to Circular 43". It's a short-term environmental quality assessment at facilities and periodic reporting to authorized agencies, such as the environmental protection bureaus, departments, or divisions.

Specific entities required to prepare periodic monitoring reports include:

  • Manufacturing enterprises: warehouses, factories, manufacturing companies, etc.
  • Industrial zones: industrial zones, export processing zones, industrial clusters.
  • Healthcare facilities: hospitals, beauty salons, spas, medical examination centers, dental clinics, etc.
  • Residential areas, urban areas: residential areas, urban areas, apartment buildings.
  • Waste treatment facilities: landfills, transfer stations, incineration plants.
  • Commercial and service fields: Office buildings for rent, real estate,...; Service companies have EIA and environmental protection projects; Shopping mall.

Entities Responsible for Confirming Periodic Environmental Monitoring Reports:

  • Department of Natural Resources and Environment: For projects or enterprises that undergo environmental impact assessment, and environmental protection plans are approved by the Ministry of Natural Resources and Environment (MONRE).
  • Division of Natural Resources and Environment: For projects or enterprises with environmental impact assessments approved by the Division of Natural Resources and Environment.
  • Management Board of industrial zones, export processing zones, economic zones: For projects or enterprises in industrial zones, export processing zones, economic zones.

Reporting Frequency for Periodic Environmental Monitoring Reports:

  • For facilities equivalent to the entities specified in Appendix II of Decree No. 18/2015/ND-CP: Every 3 months/01 time.
  • For facilities equivalent to the entities specified in Appendix 5.1 of Circular No. 27/2015/TT-BTNMT: Every 6 months/01 time.
  • For facilities equivalent to the entities specified in Clause 2, Article 32 of Circular No. 27/2015/TT-BTNMT.

Penalties for Enterprises Not Compiling Periodic Environmental Monitoring Reports:

  • Entities under the authority of the District People's Committee: Warning or fines of VND 500,000 - 1,000,000.
  • Entities under the authority of the Division of Natural Resources and Environment or the Management Board of industrial zones, export processing zones, economic zones: Fines ranging from VND 1,000,000 - 15,000,000.
  • Entities under the authority of the Provincial People's Committee or authorized agencies of the Provincial People's Committee: Fines ranging from VND 10,000,000 - 15,000,000.
  • Entities under the authority of the Ministry of Natural Resources and Environment, Ministries, or equivalent agencies: Fines ranging from VND 15,000,000 - 20,000,000.
  • Entities with registration that meets Environmental Standards and equivalent environmental profiles confirmed by the Ministry of Natural Resources and Environment, Ministries, or equivalent agencies: Fines ranging from VND 20,000,000 - 40,000,000.

Essential Documents for Registering Environmental Monitoring:

  • Business registration certificate/Investment license.
  • Certificate of land use rights/Lease contract.
  • Decision approving the Environmental Impact Assessment/ Environmental Protection Plan.
  • Registration book for sources of hazardous waste.
  • Contract for hazardous waste collection and treatment, non-hazardous solid waste, and domestic solid waste.
  • Confirmation of completion of environmental protection works and measures.
  • Depending on the industry, the required documents may vary.
