Circular 10/2021-TT-MONRE regulates environmental monitoring techniques and management of environmental information and data

Circular 10/2021/TT-MONRE was issued by the Ministry of Natural Resources and Environment on June 30, 2021. Some new points of Circular 10/2021-TT-MONRE

Circular 10 will officially come into effect on August 16, 2021, and on the same day, Circular 24 will cease to be effective. Circular 10 replaces Circular 24, which does not significantly affect businesses that have already installed monitoring stations. However, there will be certain changes in regulations for businesses wishing to install monitoring stations from August onwards.

Circular 10/2021/TT-MONRE, which was issued by the Ministry of Natural Resources and Environment on June 30, 2021, replaces Circular 24, which regulated environmental monitoring techniques and was issued on September 1, 2017.

Circular No.10 will officially take effect on August 16, 2021, along with Circular No.24 which will terminate on the same day.

The fact that Circular No.10 replaces Circular 24 does not have much impact on businesses that have installed monitoring stations.

However, for businesses aiming to install monitoring stations from August onwards, there will be certain regulatory changes.

The new regulations in Circular 10/2021/TT-MONRE

In contrast to Circular 24/2017/TT-MONRE, which had several limitations such as:

  • Measurement methods, sampling, and environmental analysis were not adjusted to practical applications.
  • Technical characteristics of ambient air monitoring stations and automatic continuous surface water quality monitoring were not clearly defined.
  • Wastewater and emission monitoring equipment had certain issues that did not align with reality.

Therefore, Circular 10/2021/TT-MONRE addresses these limitations and meets the basic requirements and technical characteristics for surface water quality and ambient air quality continuous monitoring stations (Chapter VI, Sections 26, and 29). It clearly defines parameters such as temperature, pH, DO, TSS, COD (surface water) and O3, NO2, SO2, CO (ambient air).

Requirements for wastewater and emission monitoring systems:

  • At least one measurement range with a value >3 times the limit value (except for temperature, pH of emissions, and temperature, flow, and pressure of emissions).
  • Cameras must have pan and tilt, night vision, ensure clear observation of the subject, and record real-time images.
  • Regular system checks
  • Routine maintenance, calibration, accessory replacement, repair, and instrument replacement.

The subjects covered by Circular 10/2021-TT-MONRE

Circular 10/2021/TT-BTNMT applies to organizations and individuals involved in environmental monitoring activities.
However, in Chapter II of this Circular, it does not apply to environmental monitoring for offshore oil and gas activities.

Monitoring management software meets Circular 10/2021-TT-MONRE

Designing and implementing environmental data monitoring software is not a simple task and requires businesses to have a deep understanding of the technical specifications of each system.

  • Automatic and online monitoring: Monitoring of automatic and continuous measurements, directly connected to the monitoring system for resource management (referred to as the monitoring system).
  • Management of information on common resource licenses issued by central and local authorities; collection of measurement and monitoring data from resource exploitation projects and other data to support monitoring.

  • Leaders of the Department of Natural Resources and Environment (LD): Oversee and control remote sampling, issue directives to relevant departments.
  • Data management departments of the Department of Natural Resources and Environment - Department of Water Resources and Meteorology (QL): Manage data of projects in the area, ensuring environmental safety.
  • System Administration (QTHT): Configure the system, make necessary settings to operate the system and handle problems that arise during operation.
  • Water resource exploitation and use facility (CSKT): Responsible for fully updating information about water resource exploitation projects and license information.
  • Citizens: Monitor data published on the online portal system.
