Inspection Law No. 11/2022/QH15 dated November 14, 2022 of the National Assembly, effective from July 1, 2023.
According to Article 111: Wastewater monitoring according to the latest Environmental Protection Law 2022 stipulates:
Subjects must monitor wastewater automatically and continuously
According to Article 111 of the latest Law on Environmental Protection 2022, objects of automatic and continuous wastewater monitoring include:
+ Concentrated production, business and service zones, industrial clusters discharging wastewater into the environment;
+ Investment projects and facilities that are at risk of causing environmental pollution with average or higher wastewater discharge into the environment;
+ Investment projects and facilities that are not at risk of causing environmental pollution with large amounts of wastewater discharged into the environment.
Subjects must periodically monitor wastewater
- Concentrated production, business and service zones, industrial clusters discharging wastewater into the environment;
- Investment projects and facilities with large amounts of wastewater discharged into the environment.
Regulations in Clause 1, Article 97 of Decree 08/2022/ND-CP: The wastewater discharge rate is calculated according to the total design capacity of all works and equipment discharging wastewater into the environment recorded in the document. environmental permits and are regulated as follows:

Periodical monitor wastewater
The wastewater discharge rate is calculated according to the total design capacity of all works and equipment discharging wastewater into the environment recorded in the environmental permit.
- Parameters and frequency follow GPMT. Monitoring parameters are based on standards, type of production, raw materials, production technology, and waste treatment technology.
- Monitoring frequency: every 3 months (projects, facilities preparing environmental impact assessment reports) and every 6 months for the remaining cases.
Automatic and continuous wastewater monitoring
Deadline for completing the installation of an automatic, continuous wastewater monitoring system (with surveillance cameras and automatic sampling equipment) and connecting and transmitting data directly to specialized agencies on the environmental protection Provincial level no later than December 31, 2024 for projects, establishments, concentrated production, business, service areas, industrial clusters with the level of wastewater discharge into the environment specified in Column 4 of Appendix Appendix XXVIII issued together with this Decree.
From January 1, 2025, investment projects with the level of wastewater discharge into the environment specified in Column 4, Appendix XXVIII issued with this Decree must install an automatic wastewater monitoring system. prior to trial operation of the waste treatment facility.
For projects and facilities discharging cooling water that use chlorine or disinfectant chemicals to kill microorganisms into the environment with a flow of 1,000 m3/day (24 hours) or more, the project or facility owner must install these Automatic, continuous monitoring parameters include: flow, temperature and chlorine for that cooling water source;
The owner of the project, facility, concentrated production, business, service area, or industrial cluster shall send a written notification according to the form issued by the Ministry of Natural Resources and Environment to the agency that has issued the environmental permit; In case the environmental permit is issued by a central agency (except in cases of national defense and security secrets), it must also be sent to the provincial environmental protection agency to monitor and supervise the implementation process. presently.
